Development Consent
A Development Consent was granted under the Environmental Planning & Assessment Act 1979 in 2017 and received a modified Development Consent in April 2021. A further modification to the Development Consent was approved in September 2022.
EPBC Approval
An EPBC Approval was received under the Commonwealth Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) in June 2021 , with variations to the EPBC Approval determined in June 2022 and May 2024.
Environment Protection Licence
An Environment Protection Licence was granted under the under the Protection of the Environment Operations Act 1997 in May 2024.
Compliance: Plans, Strategies and Programs
The construction and operation of the wind farm must comply with the Development Consent, EPBC Act Approval and EPL, including the preparation and implementation of the following plans, strategies and programs:

Environmental Assessment
The Project originally received planning approval for up to 92 turbines in May 2017.
In response to significant advancements in wind turbine technology (e.g. new, more efficient turbines) a modification (MOD 1) to the Development Consent was approved in April 2021. This modification increased the tip height of turbines to 200 metres and reduced the overall number of turbines to 77.
A second modification (MOD 2) was subsequently approved in September 2022, which allowed for revision of a small number of site access tracks to reduce the environmental impact of the project’s construction.

The Commonwealth Department of Agriculture, Water and the Environment (DAWE) assessed the Rye Park Wind Farm via a ‘preliminary documentation’ assessment pathway.
